These terms of service (“Terms”) govern your use of the Wetatronics website (wetatronics.com) and the ConX Portal service operated by Wetatronics Limited (“Wetatronics”, “we”, “us”).
By accessing or using our website or services, you agree to these Terms. If you do not agree, do not use our services.
Use of the website
You may use this website for lawful purposes related to evaluating, purchasing, or using Wetatronics products and services. You must not misuse the site or attempt to gain unauthorized access to any system or data.
ConX Portal service
Account responsibility
If you create a ConX Portal account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly if you become aware of any unauthorized use.
Acceptable use
You agree not to use the ConX Portal service to:
- Violate any applicable law or regulation.
- Transmit malicious code or interfere with the operation of the service.
- Attempt to access devices, data, or accounts belonging to other users.
- Reverse-engineer, decompile, or disassemble any part of the service.
Service availability
We aim to provide reliable access to the ConX Portal but do not guarantee uninterrupted availability. We may perform maintenance, apply updates, or suspend access as needed. We will make reasonable efforts to provide advance notice of planned downtime.
Data and device access
ConX Portal stores device metadata, serial console logs, and configuration data that you submit or that your ConX-SFP devices transmit. You retain ownership of your data. We will not access your data except as necessary to operate the service, provide support you request, or comply with legal obligations.
Intellectual property
All content on the Wetatronics website — including text, graphics, logos, software, and documentation — is the property of Wetatronics Limited or its licensors and is protected by copyright and other intellectual property laws.
ConX-SFP, ConX Portal, and Wetatronics are trademarks of Wetatronics Limited.
Limitation of liability
To the maximum extent permitted by law, Wetatronics is not liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim related to the service is limited to the amount you paid us in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Wetatronics from any claims, damages, or expenses arising from your use of the service or violation of these Terms.
Termination
We may suspend or terminate your access to the ConX Portal service if you violate these Terms. You may close your account at any time by contacting us. On termination, we will make your data available for export for a reasonable period.
Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
Changes to these terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the service after changes constitutes acceptance of the updated Terms.
